1. Introduction
1.1 These general terms and conditions apply to the use of our website and to the purchase of any products offered through our website.
2. Acceptance
2.1 You represent and warrant that: (a) you are a natural person and at least 18 years of age; (b) you have the authority to enter into a legally binding agreement with us; and (c) you are not prevented by any applicable law from entering into a legally binding agreement with us.
2.2 We reserve the right to request written confirmation of your authority to accept these terms.
2.3 By placing an order, you confirm that you have read these terms carefully and in full, and that you agree to be bound by them.
2.4 If you do not agree to these terms, you may not use the website or purchase any products.
3. Personal Use
You acknowledge that you will use the website to purchase products solely for your own personal, non-commercial use.
4. Pricing
4.1 The prices of the products shown on our website include delivery costs, but exclude any fees, taxes, duties or other government charges.
4.2 All duties, taxes, charges and declarations relating to the import of the products to the delivery address are your responsibility and are not included in the price. In some cases, deliveries may incur additional costs that the seller is not responsible for and that must be borne by the customer. These include customs charges or import GST. Our goods are always shipped "duties and taxes unpaid". The buyer is the "importer" and is responsible for the correct payment of duties and/or import taxes. Please check your country's import duties and taxes before placing your order.
4.3 We do our best to ensure that all details, descriptions and prices are correct. If a pricing error has occurred, we will notify you and give you the option to confirm your order at the correct price or to cancel it.
4.4 We are not obliged to fulfil an order if the price shown is incorrect.
4.5 Prices may change from time to time, but such changes will not affect an order for which an order confirmation has already been sent.
5. Placing an Order
5.1 Once you have placed an order, all orders are subject to stock availability. If we have sufficient stock, you will receive an order confirmation. In the event of delivery difficulties or a stock shortage, we will inform you by email and refund any payments made.
5.2 A contract is only formed once we have issued an order confirmation, and applies only to the products listed in that order confirmation.
5.3 If your order consists of more than one product, the products may be delivered separately.
5.4 We reserve the right to remove products from the website at any time and to refuse or reject any order.
5.5 If we cancel your order after payment, you will receive a full refund.
6. Payment
6.1 You may pay using any of the payment methods listed on our website.
6.2 By placing an order, you confirm that the payment method used is yours and that you have sufficient funds available.
6.3 We are not responsible for the unauthorised use of your payment methods by third parties.
6.4 You must not make, or attempt to make, any chargeback in respect of payments made for products.
7. Delivery
7.1 We aim to deliver your order to the delivery address provided at the time of ordering.
7.2 We provide an estimated delivery date at checkout.
7.3 Goods are dispatched within 2–5 days of confirmed payment. Standard delivery time is 5 to 8 business days, and in exceptional cases up to 4 weeks.
7.4 All risk in the product passes to you on delivery.
7.5 All duties, taxes and other charges relating to the import of the products are your responsibility.
8. Cancelling or Changing Orders
8.1 Once an order has been placed, you may cancel or change it by sending us an email within 24 hours.
8.2 Once an order has been packed or dispatched, it can no longer be cancelled or changed; the order must be returned in accordance with our returns policy.
8.3 Because we work with a fully automated system, orders are triggered immediately. A refund before receipt of the goods is only possible up to 24 hours after the order is placed.
9. Faulty Products
9.1 If the product you receive is faulty, you may send us an email with a photo of the faulty product.
9.2 Our obligation in respect of faulty products is either: (a) to replace the product at our expense; or (b) to refund the price of the product.
9.3 Images of products may differ slightly from the actual product you receive.
10. Returns and Refunds
10.1 If you are not completely satisfied, you may return the product within 30 days of receipt.
10.2 Return costs are paid by the customer.
10.3 The product must be returned in the same condition in which you received it: unused, with labels intact and in its original packaging.
10.4 If we are satisfied with the condition of the returned product, a refund will be issued to the original payment method.
10.5 Nothing in this clause limits your rights under the Australian Consumer Law, including your rights to a repair, replacement or refund where a product is faulty, not as described, or otherwise fails to meet a consumer guarantee.
11. Discount Codes
11.1 Promotional codes may be applied at checkout. Only one code per order.
11.2 Credit from a promotional code does not earn interest and has no cash value.
11.3 If a promotional code was used on an order that is returned, the value of the code will not be refunded.
12. Acceptable Use
12.1 You must not use our website in any unlawful, fraudulent or harmful way. You must not carry out automated data collection, introduce viruses or malicious software, or attempt to gain unauthorised access to our systems.
13. Intellectual Property
13.1 We are the owner or licensee of all intellectual property rights on our website and in our content. All rights reserved.
14. Data Protection
14.1 Our privacy policy forms part of these terms.
15. Liability
15.1 Our liability arising from these terms shall be limited to the greater of AUD 1,000 or five times the price you paid for the products.
15.2 We are not liable for loss of profit, business opportunity or goodwill, or for any indirect, special or consequential loss.
15.3 These limitations do not affect our liability for death or personal injury resulting from our negligence, or for fraud, or any liability that cannot lawfully be excluded, including under the Australian Consumer Law.
16. Force Majeure
16.1 If a force majeure event continues for more than one week, we may terminate these terms by written notice and refund any products paid for but not delivered.
17. Governing Law
17.1 These terms are governed by and construed in accordance with the laws of the Netherlands.
17.2 Any disputes arising out of or in connection with these terms shall be referred to the exclusive jurisdiction of the courts of the Netherlands.
